If the court does so, the new conservative majority could significantly change the law on religious liberty and LGBTQ rights. The justices could announce as early as Monday whether they will hear the case. For nearly three decades, the court has followed a rule set down in a decision written by a conservative hero, the late Justice Antonin Scalia. In the Oregon case, lawyers for Melissa and Aaron Klein said the couple were forced to shut down their Sweet Cakes store in the city of Gresham because of the conflict over their religious beliefs.

Gay marriage is now legal in America. Marriage, which has for millennia been defined as a heterosexual institution, is being redefined. In fact, its historical essence is being declared illegal. Although many see the redefinition of marriage as positive, few have examined the nature of the argument used to secure that redefinition. Yet, the nature of the argument that won a five-to-four majority in the US Supreme Court was as profound as the outcome.
Thus, I am not opposed to civil unions for gays. Now, gay marriage backers say exactly the opposite. While I am not a lawyer, and while I have not studied the issue in sufficient depth to comment in detail, I do know that, while the law does treat formalized marriages the same as it treats their informal counterparts in many ways, it does not do so in all material ways.
